Terms of Service

1. Thank you for choosing Sands of Time Multimedia Creations Inc. to create your multimedia slideshow presentations. These Terms of Service govern your use of Sands of Time's service. By placing an order with us, you are stating your agreement to these Terms of Service, and thereby creating a binding legal agreement. You should therefore carefully read these Terms of Service. You must be 18 years of age or older to use our services.

2. When creating an account you must provide true, accurate, current and complete information. If the information that was given changes over the course of the time in which you are using our services, you agree to notify Sands of Time Multimedia Creations Inc. of these changes.

3. With the exception of paragraph 7 of this Terms of Service, all materials sent to Sands of Time Multimedia Creations Inc. will be returned to you. This includes all photos, film or digital, all slides, videos, documents and cd's.

4. Sands of Time Multimedia Creations Inc. produces multimedia photomontages / video montages using your photographs, digital photos, slides, negatives, video clips, documents, and subject to this agreement, music you provide to us. Your photos are scanned, enhanced and organized in a slideshow that is set to either your music of your choice or to the royalty-free stocked music of our choice. The photomontage / video album is then recorded onto a VHS tape or DVD using DVD-R or DVD+R specifications that can be played in most DVD players and VCR's. It is your (the customer's) responsibility to make sure that your DVD player is compatible before you place your order. We cannot accept returns or cancel orders after they have been processed. You must provide the information for your slideshow including but not limited to: written titles to be included in the show, the order of music and corresponding photographs, music titles, and any other special requests. If your purchase is a gift you must specify this so that representatives of Sands of Time Multimedia Creations Inc. do not inadvertently discuss the show with the intended recipient, should we need to contact you. You may include as many images as you would like, but should the total time exceed the limit of the DVD, the photomontage may be recorded onto multiple DVD's. Quality of your photomontage can only be guaranteed if the photos are scanned at 300dpi or better for images 3x5 or larger, and 600dpi or better for images smaller than 3x5 using RGB color settings and a 100% quality JPG setting or other non-compressed image format. You will be notified in advance to the photomontage being created if Sands of Time Multimedia Creation determines that your scanned images are not suitable for production. You will then have the option to cancel your order or to rescan the pictures or send us the pictures to be scanned. Or you can authorize Sands of Time Multimedia Creations Inc. to use the images "as is" with your understanding that we will not be able to guarantee the quality of the final product. Should you choose to cancel the order you are still liable to pay all shipping, handling and return charges.

5. Sands of Time Multimedia Creations Inc. shall not be liable for any photos - digital or film, - slides, videos, documents, or music while in transit through or in the possession of any mail carrier or courier including but not limited to the U.S. Post Office, Fed Ex, UPS, etc. We will not be liable for any loss, any damage, or any theft of the above mentioned while in transit through or in the possession of any mail carrier or courier. It is your responsibility to insure the contents of your package, place them in waterproof packaging and to write the words "DO NOT BEND" clearly on the outside of the package.

In addition, if you choose to send us photos while still in the photo albums, Sands of Time Multimedia Creations Inc. and its' employees will not be held responsible or liable for damage done to photos or the photo album while trying to remove the photos for scanning. Old photos and photo pages that have been in photo albums for decades are very fragile and can very easily tear or rip. Although extreme care is taken when handling photos in albums, this is sometimes unavoidable and happens at the slghtest touch.

6. Sands of Time Multimedia Creations Inc. uses the images and music you supply us or the royalty-free stock music to create your photomontage. These include original (not copied) music cd's that you provide to us, or music that you ask us to purchase for you and on your behalf from a legitimate vendor. It also includes hard copies or image files of your photos, slides and documents. You are responsible for all images and music chosen to be incorporated in the video. You must have the right to use the images and music you supply to us or that you ask us to purchase on your behalf. By placing an order with us you are representing and warranting to Sands of Time Multimedia Creations Inc. that you have that right, that all images you supply belong to you, that all music CDs you supply belong to you and were purchased by you from a legitimate retail vendor for your own personal in-home use, and that you have obtained any third party permissions that may be necessary to use the images and the music you are supplying or are asking us to purchase on your behalf for your photomontage slideshow. By placing an order with us, you are also agreeing to indemnify Sands of Time Multimedia Creations Inc. against any liability that might arise as the result of a claim by any third party that inclusion of the materials ( images and/or music) you supply to us or ask us to purchase on your behalf for use in your photomontage violates any copyright or other right of any third party. Sands of Time Multimedia Creations Inc. expressly disclaims any responsibility or liability to any third party arising out of the content of the materials (images and/or music) you supply us or ask us to purchase on your behalf for inclusion in your photomontage, and you agree to be solely responsible as to any such claim.  Sands of Time Multimedia Creations Inc. assumes no responsibility or liability with respect to any copyright infringements and the customer hereby agrees to assume all responsibility for any and all costs and expenses incurred by Sands of Time Multimedia Creations Inc. as a result of any legal action or litigation taken against Sands of Time Multimedia Creations Inc. as a result of an alleged copyright infringement. By requesting the services of Sands of Time Multimedia Creations Inc. and in the submission of photographs, slides and music to us you are stating that you own the copyright or have expressed permission to use such copyrighted material. Furthermore, by purchasing services through Sands of Time Multimedia Creations Inc. you agree to never make copies of the slideshows created for you without express written permission from Sands of Time Multimedia Creations Inc. and never to sell, rent,  or profit from the slideshows created without express written permission from Sands of Time Multimedia Creations Inc.- they are created solely for your purpose and are protected by the copyright laws of the United States of America. You understand and acknowledge that is a criminal offense to copy slideshows created by Sands of Time Multimedia Creations Inc., and therefore punishable by law. Sands of Time Multimedia Creations Inc. reserves the right to use your production, or parts of your production as a video sample on our web site or to customers looking for the creating of a similar project.

7. Sands of Time Multimedia Creations Inc. is a privately owned company. We do not discriminate against race, creed, sex, or age. We do however, reserve the right to refuse any work for any reason at any time. Sands of Time Multimedia Creations Inc. will not accept pornographic material in any form. If sent to us all such material will not be returned but will be destroyed immediately at our discretion and we will not be held liable for any such loss. In addition, for the protection of minors Sands of Time Multimedia Creations Inc. will disclose any child pornographic material to the proper authorities with all known information of the sender.

8. Disclaimer - To the fullest extent permissible pursuant to applicable law, Sands of Time Multimedia Creations Inc. disclaims all warranties express or implied, including, but not limited to, implied warranties of its products and services. Under no circumstances shall Sands of Time Multimedia Creations Inc. be liable for any damages, including but not limited to any direct, indirect,, incidental or consequential damages to  customers photos (film or digital), slides, videos, music cd's or and other materials including, but not limited to as a result of theft, fire, flood, natural disaster, war, or terrorism. By purchasing the services and/or products available through this site you are agreeing to all terms and conditions contained herein.

9. There is a 100% guarantee that covers your satisfaction until approved by you  (verbally or written) after viewing your on-line preview. You will be able to view your slideshow on-line and be able to make changes free of charge - within the parameters of the guidelines you gave us - to the video production via correspondence by phone or email with a Sands of Time Multimedia Creations Inc. representative. (Please note: In order to protect our company's name and reputation, Sands of Time Multimedia Creations Inc. reserves the right to refuse any modifications to your slideshow that we determine will lessen the final quality and/or character of the slideshow.)

Any changes you desire to make after viewing your slideshow which are outside the parameters of the guidelines you gave us - for example: adding or changing photos, changing the order of your photos, or changing your song selections may require additional fees which will be determined by your slideshow creator based on the additional time involved in making these changes.

Once approved by you - verbally or written - and changes are made, this will be your final production and our guarantee will be fulfilled and no further changes to your slideshow production will be made under the terms of this guarantee. We do however, keep your editable slideshow files in our system until the date of your event and if you decide that you want additional changes made we can make those changes for you at a cost to be determined by a Sands of Time Multimedia Creations Inc. representative.

For our customers who are not able to view the on-line preview, the guarantee covers your satisfaction for up to 3 days after receiving your slideshow or until the date of your event (whichever comes first). You must return to us the original DVD(s) and/or VHS tape(s). There is never a monetary refund and you must pay all shipping charges.

Starting on the date of your event the editable files of your slideshow are deleted from our system and no other changes can be made to your slideshow production. We can, however, still make copies of the original slideshow for up to two years after the date of your event at the cost stated on our pricing page. 

10. These Terms of Service shall be governed by the laws of Tennessee where Sands of Time Multimedia Creations Inc. is organized. If a court should find any one of the provisions of these terms not enforceable, you agree that the remaining terms shall remain in force. Further, these Terms of Service represent the full agreement between you and Sands of Time Multimedia Creations Inc. . Sands of Time Multimedia Creations Inc. has the right to modify these Terms of Service at any time. If you should continue to use the service after notice of the changes, your use will constitute an acceptance of the changes.
